The Yomiuri reported earlier this month about allegations of Sahashi using an employee's fund for his own purposes. It looks like the police have enough evidence to launch a criminal investigation into the embezzlement of those funds. Here's the story from the Asahi Shimbun:
Update 6/23 Edited since the Asahi has posted their translation of the story.
Police suspect that the former president of Nova Corp., the now-bankrupt chain of language schools, embezzled employee union funds to pay off students who canceled contracts with the beleaguered company, sources said.
Police believe Nozomu Sahashi, 56, illegally yanked 300 million yen from the company's mutual assistance union in July last year right after the industry ministry partially suspended Nova's operations for shady business practices.
About 2,400 Japanese employees were required to contribute to the fund.
Sahashi apparently used the money to repay many students who canceled contracts with Nova and to take care of other pressing debts, according to the Osaka Prefectural Police Department.
Investigators plan to interrogate Sahashi and raid former Nova facilities this week at the earliest.
Comment: Of all the things the things Sahashi may be guilty of, it may seem odd that the police are pursuing this seemingly lesser charge. My guess is that this is a charge that will stick since there appears to be no shortage of evidence and disgruntled employees to help the police connect the dots. When they investigate and arrest Sahashi, police interrogations will no doubt yield further charges.
More from The Japan Times:
The Osaka Prefectural Police will soon open a criminal investigation against the former president of failed language-school chain Nova Corp. on suspicion of embezzling a ¥320 million special employee welfare fund, sources said Sunday.
Nozomu Sahashi is suspected of ordering the accounting staff at the Osaka-based firm to transfer all of the money in the fund to a company account on July 20, 2007.
He allegedly used the money to refund students who canceled lessons after the school was ordered by the government the previous month to suspend part of its business over exaggerated advertisements, the sources said.
[...]
A former Nova board member said he believes a substantial amount in the special fund had long been used as company operating money.
"Even the board members did not know where the money actually went. Part of it may have been used as a slush fund for the president," he said.
An agent for Sahashi said the former president did not realize the money had come from company employees and used all of it for the refunds. The agent denied Sahashi used the money for his own personal expenses.

The FULL weightof the law
I'm sure the FULL weight of the law will come down, on Sahashi, and he can look forward to twenty five, or even thirty days, in prison!
Ya right! Whatever man.
Ya right! Whatever man. Since when have you heard of white collar criminals getting 25 -30 in prison. Not in the world I live in.
After all that's happened,
After all that's happened, the only thing they will be able to pick him up on is the embezzlement of the company's welfare fund? Retarded,

A Post So Nice
they posted it twice.
Why so long?
Why on Earth did it take 8 flipping months to build a case as little as this? He did so many things wrong its ridiculous! Are many of the things he did here, which would have been more than enough to put him away for a while in western countries, actually legal in Japan?
Japanese people need to get seriously fed up with their law and make some changes.
Saying nothing changes nothing.

Hey, remember they got Al Capone on tax evasion. The main thing is that Sahashi goes to jail.
Any chance he's still in Japan?
Bollocks
Saruhashi Monkey Bridge reckons he did not know the money was not the company's
I say bollocks, anybody with half a brain would know that this kind of employees fund is the money of the employees and the company has no right to use it. Also, there should be a constitution or articles defining how the money is used. Ok Monkey Bridge, show us where it says you can use the money! ANd don't say you didn't know, 4 million bucks is a lot of money to pinch - even if it for the company, it is not your money!
Also, teachers would not be in this contribution scheme, it would just be Japanese staff and cronies like Lord Flemming and Anders AKA Hans Kruger
Money
What I want to know is what happened to the thousands of dollars that were taken from all the branches the morning of October 25 (day before melt down). In each area one staff member was told to quietly visit all of the branches before they opened to collect massive amounts of cash and then take it to specific locations. I know the money was there because I was with the staff member collecting it and they staff hadnt deposited any cash into the banks for the final 3 months of operations. All nova kids students paid with cash as they were told nova was changing there systems....
That money may have went directly to Monkey man. I would love to give an eye witness account to the police if it would help seal his destiny!
But..... building a case that
But..... building a case that will hold up to scrutiny in court against a well paid lawyer is just a wee bit more complex than saying 'my mate's brother's dog said he saw a guy looking like saru nicking money' on an internet forum.
Hopefully the 8 months of case building will prevent any mishaps in court ............. mind, if the cunt gets acquitted ........
My bad. He did say "DAYS."
My bad. He did say "DAYS." Misread and now I feel a bit..... well.... foolish. Just used to the superficial, non witty, immature comments lately and had a bit of a knee-jerk reaction. Sorry Jimmy.
