The General Union has posted details of an agreement between G.communication/G.education on their website. As you are aware, ever since NOVA went bankrupt, the General Union has been busy trying to get G.communication to rehire all of the instructors that were fired when G.com took over. It appears that they have succeeded.

The gist of the deal is this: G.communication will apologize for not employing all NOVA instructors and will make efforts to rehire them.

There are six key points of the agreement:

A: Both G.communication and G.education will express their regret regarding the inability to employ instructors despite having promised jobs to all instructors who have lost their jobs or have been forced to return to their home countries.

B: To address the issue of instructor shortages, the General Union will cooperate with introducing instructors in areas where they are needed.

C: G.education will make efforts to reemploy all former NOVA instructors not actively working at their current schools. The General Union will cooperate with the recruiting and hiring of instructors.

D: G.education will offer 1-year renewable employment contracts and shakai hoken (pension and health plan). In principle, the contracts of instructors currently employed with G.communication will have their contracts renewed.

E: In order to increase lesson and employment opportunities, G.education will open schools in the Kansai and other urban regions and offer courses in other languages in addition to English.

F: Both G.communication and G.education, who effectively operate NOVA, will, in good faith, engage in collective bargaining with the General Union, and strive to uphold labor laws.

If you're a former NOVA instructor, there may be a job waiting for you. Is G.communication a day late and a dollar short with this? Would you want to work for them if they offered you your old job back?

I honestly do not know how this is on the up and up.

In that case- shouldn't the General Union be offering to help recruit for all the other English Conversation schools? Where was the union when the teachers first lost their jobs?

New schools only in the urban areas? Well, that rules me out.

When a company (or crooked CEO) in Japan makes an apology, it really one means one thing:

Absolutely nothing.

And really, there's no excuse for apologizing anyway. Companies that make these kind of huge errors deserve to go bankrupt to make room for better companies.

That, of course, doesn't explain the Twilight Zone that has become of Nova.

The language in the "victory" for the union is so watered down

The only clause without an esacpe clause/phrase is the first one, and that one means nothing. Highlights below...

B: areas where they are needed (As determined by? This is already the problem, nobody wants to move to another town with no safety net, or maybe nobody is "needed" at all, so no hiring)

C: make efforts (Yoda would have something to say about that one..Try? Try not! Do! Or do not. There is no "try".)
The General Union will cooperate with the recruiting and hiring (so they can be just as vindictive as the Nova management? "Join the union or else!")

D: will offer ("offer" just like they "offer" 4,000,000 yen salary, which they won't pay in full anyway, IF you move to West Bumfuck, Japan)
...In principle...(so, basically, they'll think about it and then say "No")

E: open schools (no clause about not CLOSING schools...good job Union!)
in the Kansai (Japan Sea coast Hyogo is still Kansai)
other urban regions (by their definition, Wakanai in Hokkaido is probably "urban"
other languages (Chinese? they hired Chinese already to run their offices, just make them work more overtime teaching, too)

About a month ago I was asked to transfer to another city or lose my contract. Moving is not as easy as they seem to think it is so I left the company. It only took two weeks to find a new job that pays better, has better insurance, a better working environment, and a company car. Last week I got a call asking if I wanted to go back to my old branch. They said same salary and same schedule. I laughed and hung up without even answering. Who would go back? They have lied about everything since the beginning. I feel sorry for the instructors left in my old branch. every lesson is booked solid and students are leaving. As the numbers go down instructors will be cut further. This is too little too late.

they tried to call my boyfriend last night. he got a missed call; it was from a landline number with an area prefix we didn't recognise. called it back, it was nova. promptly hung up after hearing the word 'nova'. no thankyou.

I spoke to a student that goes to the g-string Higashi Kishiwada school tonight. They have two teachers there or something ridiculous like that. They cannot get lessons. Nothing is ever available and there arent any interesting teachers cos the only ones left are the ones with kids and J wife or hubby. (She said this not me.)

A little bird told me that neo-Nova is going to be VERY selective about sponsoring new visas. Apparently, the powers that be feel that "loyalty to the company" should be the key consideration. In other words, they prefer unmotivated "lifers" with spouse visas over everybody else.

No deal they make with the union or anyone else is worth the paper it is printed on unless they have a lot of full-price paying students (and a steady stream of new ones to make up for attrition) to support the company, teachers etc.

Does anyone have the numbers on this???? From what I read here and my experiences in Japan and running a school, I cannot possible see how they have enough full-paying students to even be out of the red. What in the world are these people thinking??

Also, I wonder about there empty locations. There is on on Osaka I often pass by. It is in a prime location and the signs are still up, but the school has been closed since last year!! What in the world? Who owns this place? If it is Nova, why don't they open it? If it is another landlord, why don't they evict them and make some money off of the location??

Hang on, if you say G Com only want people on spousal visas, then they don't need to sponsor them in the first place. I'm renewing my spousal visa at the moment and immigration just wants to see proof that you are working there, so I just gave them a copy of my contract.
Anyway, if they don't sponsor work visas they're going to have very few teachers indeed.

A lot of students returned despite some negative press in december-march because most of the Japanese public preferred to take the new NOVA's side over the mistreatment of instructors. But if the booking problems affecting students get out that will be a different story.

I think this is a call for help proving that the management-induced instructor shortages have stunted G.com NOVA's growth, preventing students currently on 25% from re-signing on 100%, and nothing they've tried will solve the problem quickly enough.

The union probably can't do much for NOVA's recruitment directly (surely not that many members are still waiting in the wings) so this is more an attempt to regain the trust of esl instructors.

I wish someone could do a survey of NOVA students, 'cause only G.com would have the numbers you're referring to and they probably don't want to share it with us. While I was there less than 5% were new students and we didn't sign any new kids.

The one thing that might be keeping them in the black now, or close to it, is their obsession with maximizing capa and increasing the maximum class size to 5.

GCOM has finally realised that they need to get some of their old instructors back and the union claims that they`ve achieved some kind of victory by agreeing to help them achieve this goal? There has to be some serious fucking dementia down at the union office.

By telling them that G-comm will rehire them is well within that mandate. This does not mean a recruitment drive it means contacting members and seeing if they want their jobs back. If the General Union got jobs back then that's a victory. If a union member tells G-comm to stick it up their ass that's there prerogative.

There are a few 100% paying students...not that many...there are not that many teachers really either...the company is making money selling franchises though...lots of people are buying them...the company is just having a problem supplying the franchise owners with teachers...to help make the books look healthier some parts of G.ed have been attached to different parts of G.com...like G.network...to spread the loss around...Mr Inayoshi is enjoying things though apparently...he loves gambling and he's likened the current situation at Nova to when you're gambling and you're not sure how things are going to pan out...whether you'll win or lose...but it's exciting...you're heart's in your throat...you get that compulsive rush...come in spinner...

But I definitely don't think the union should get all the credit for this 'victory'. It comes as a result of a mass exodus of disgusted instructors, most of whom never joined the unions (including myself and every co-worker I know who left G.com).

I'd like to know who initiated this agreement. Did the unions make some kind of threat to strike, or to go public about the student complaints? Or did G.com go to the unions for help? It looks to me like the latter, in which case this 'victory' literally fell into the union's lap.

Why is the union acting as a recruiter for g-com? its another example of them beig idiots. What do they possibly have to offer? What safeguards can they give, to anyone who they try to promote or offer to g-com, when they were absolutely powerless to stop what was happening a few months ago? We have no details, but I'm guessing that will involve no more than the the union sending a bunch of emails to it's members saying there are jobs available, and I don't see why that would be a conflict of interest.

I think the agreement is symbolic. It's too late for the union to be able to help with this problem directly, as they can't have that many instructors still waiting in the wings, but this deal will remove the union as an impediment in G.com NOVA's recuitment.

Man have you worked outside of Nova? Have you worked in the public school system or other similar chain schools basically, most employers offer shakai hokken. Really NOVA deciding to pay something that government says is mandatory for all fulltime employees over 37.5 hours a week (exact figure i'm not sure you can google it maybe on the general union site!!) is not something to be thankfull for. I dont think financially its in the best interest of the majority of short term Nova employees anyway. I'm not a union member because I didnt believe the were effective, due to NOVA being ruthless and not respecting any kind of law and the short term nature of the majority of employees. I dont work for Nova now anyways, but the few years I did I never felt they had any teeth. Right, so we have some agreement. I agree that the eikaiwa unions have limited power, but that's mainly because they are not compulsory, and so many employees are only in Japan for a short time so they don't really need to join. In fact I don't think I'd even heard of the union until NOVA failed to pay our salaries. I don't know any members in my area at all.

The unions are obliged to look after their members first. Others benefit as a by- product of the union's efforts.

Tench used to be one of the heads of the Nova union... he still could be for all I know.

LOL his name was in quite a few news articles just before and after the bankruptcy so I guess he still is. What better way for G.com to show their sincerity in a deal that is designed to repair it's reputation amongst esl instructors than to re-employ one of their most prominent critics?

Weren't you around when all this trouble happened or were you asleep. The General Union was in there fighting for us. They had meeting to give NOVA teachers (both members and non members) advice and they organised demonstrations outside the Labor bureau.

Does anybody with half a life really CARE ANYMORE about Nova? Guys who I knew at Nova have moved on for the better!!

If you agree with my analysis of the company then why do you continue to work there? If you work in a branch in the middle of Gifu with limited job opportunities then fine. But if you work for NOVA in a city like Osaka or Tokyo Nagoya etc. then you dont really have an excuse for not looking elsewhere. Its not a question anymore of "personal choice" you are an active part of a dishonest organization, to put it politely at best, and you are willingfully participating in it. For financial gain or whatever. Therefor you are a loser. Just because you didnt pull the trigger doesnt make you any less culpable now does it? Personal choice involves something that doesnt have a detrimental affect on others and you cant argue that NOVA hasn't done that. So if you are working for NOVA/GCOM in an area with other job opportunities and you are choosing not look or find something else, then that reflects on you. And you will have to put up with negative bullshit cos frankly you deserve it.

As I wrote before I am just curious as to why you care so much .I'm sure that it is not because of your altruistic nature.

Is this discussion forum moderated? I don’t think so. I worked for eight years at Nova, and it was the best job I ever had. In the most part, all teachers were happy. This discussion group has attracted the vocal minority. Whiners speak out the loudest, like in here, but by and large, most of the teachers I worked with at Nova were very happy with Nova, and by all accounts, the new Nova is no different to the old. Whiners are spreading rumours that the new Nova is out of money, and I have no solid evidence to support my view, but by all accounts, it would appear there is more than enough money to go around, to keep Nova going, for good. Indeed, there is no justification to be spreading malicious rumours that the new Nova is any form of financial trouble. All opinions need to be respected, and I invite challenges and lively debate at any time, but to say that Nova is bad, or was a bad place to work, is not true, and nearly all people who have worked for Nova enjoyed it. I would write more, but I am kind of busy right now. Hey, I am happy to listen to and take on any opinion, but I invite you to keep it clean and respectful, if you expect my reply.

In contrast to a lot of posts you'll find here (and yours in my opinion) I think I have tried to be objective in my critisisms of G.com NOVA but you're disregarding a lot of valid criticisms that have been made by reasonable people here, and negative press which in my experience was pretty accurate.

A lot of people were lied to and tricked by G.com. The best and most obvious example was what happened to the option B instructors in december.

You say "by all accounts" so does that mean you haven't worked for G.com NOVA? If that's the case, whose accounts are you referring to?

Most Nova teachers may have been happy and may still be happy, but that happiness I would suggest is more related to their total lifestyle rather than to their views of the company. On the side of company views, there were those who were suss about Nova who constantly expressed or held in reserve cynical attitudes to that company and the students who they served, and there were those who were lost, never having worked for a large company before and having nothing to compare their experience with or to make judgements on. Some remained lost for a little longer than others, but for most it was a matter of 6 months before they started to think rationally about the real situation they were in. People with unreservedly positive attitudes to the company such as yours certainly did exist and still may do, but they were in a minority then and I suspect remain in a minority now.

The number who remain at the company now is much smaller than the number who were initially promised work and then let go in a very unpleasant manner indeed. Are the ones who were tossed on the garbage heap happy at the manner in which they were treated? Are those remaining with the company happy about their insecure job situation or the huge and glaring holes in the services that the company are offering, such as the mess that the already poor kids program has now become, the dissatisfaction of students who are unable to reserve lessons, the problems of teachers who leave going unreplaced etc. etc? Are they happy at having to do an inferior version of their basic training again and be told that it is their fault that Nova went bust? They may be handling it, but I doubt that they are happy with it. Who would be?

I can only suggest that the accounts that you are referring to are those of contacts who you have at GComm. These accounts may well express some resentment at the attitudes of posters on LJ. I wouldn't be surprised about that as some posters have been and are mean spirited. However, I doubt that your range of contacts is anything like wide enough to make the claim that most teachers at GComm are happy with their company. More likely they are irritated with being put down by all and sundry, and managing to enjoy their lives despite the problems inherent in their employment situation.

As regards the financial situation of GComm, it's anyone's guess how much water they are prepared to pour into the hole before deciding that the lake won't fill. Even if that day doesn't come, what will be left is going to be a fraction in size of the original company and the quality of what is on offer, which was already low, likewise depleted. It is, I suppose vaguely possible that through the juku connection, franchise sales and so on that GComm might once again have custom on the level that Nova once had. I strongly doubt it. Even if that did turn out to be the case, however, would you predict that they would have a sudden change of heart and start putting the kind of money that ECC has been putting into R&D for the last 20 years or more? Not a chance, I would suggest. So which company would you be better off working for - one that is interested in developing its educational services and puts the money in, or one that is not and won't? Well if you are a happy enough person generally, maybe you won't care.

I particularly like item F in the above letter. Both GCom and the union have basically agreed that GCom has broken the law in the past and will break the law in the future. I thought the idea was that you had to follow laws or there were penalties.

It has been a while since I visited this site. I was pleasantly surprised to see that some steps have been taken against the arsehole who ran Nova but to be honest I don't expect more than a slap on the wrist.

I'm really surprised that there are still people working for the company. I understand that it isn't really the same...... I have heard it is worse!

I got a call inviting me to go back a few weeks ago? No thanks, I found a much better job in the weeks before Nova's collapse.

This new company sounds like shit, and while I had some good times at Nova, none of them were due to management and either of the Head offices.

The union proved to be a monumental failure at the time of the Nova collapse. Sure they held a couple of meetings but that only made them spokespeople for management. Theire actions were by and large useless.

Months later, the General union are still trying to act like they are able to accomplish something and claim to have a victory for teachers. I understand the need for unions but the unions relating to eikaiwa have been nothing more than an ineffectual joke.

I dont need them to complain for me, I am capable of doing that myself. The only people who are doing well since the Nova collapse are those that helped themselves and made something of their lives. It is a shame that those who trusted so called professional for help (ie the union) are the ones that got screwed and many of whom are still working for such a terrible place.

Don't trust the union. Don't trust management. trust yourself!

In fact, I've heard through the grapevine that there is at least one neo-Nova teacher who hails from the Philippines. As to whether Filipinos or Indians are to be considered native speakers, this is to some extent a grey area: e.g. how many centuries of occupation and colonization did it take for the Irish to collectively transform from native Irish (i.e. Gaelic) speakers into native English speakers (with few Irish speakers left)? There may be no easy, cut-and-dried answer to this, but I wonder if there's a native speaker "acid test" for it that's more or less recognized by linguists (not just for English but for any language).

I had a Philipino co-worker in Old Nova. He said the criteria was a FULL English speaking country High school education, which he had.

if so, an acceptable criteria, I think.

Go work with AIG you might get a bonus when your company is losing money hand over fist.
